1. PRIVACY POLICY
1.1 Information We Collect
We collect information necessary to operate our websites and services, improve performance, communicate with you, and support advertising and analytics on our websites. Different categories of personal information apply to different services. We collect only the categories relevant to the services you use.
Categories of personal information we may collect:
Identifiers (name, email address, phone number, user ID, IP address, device identifiers) — all services
Contact information (email, mailing address for shipping) — all services
Payment information (processed via Stripe; we do not store card numbers) — paid services only
Health and biometric data (heart rate, resting heart rate, VO2 max estimates, body composition including height, weight, body fat percentage, and circumference measurements) — fitness services only; see Section 1.7
Fitness activity data (workout duration, distance, pace, load carried, elevation, effort ratings, workout classifications) — fitness services only; see Section 1.7
Location data (GPS coordinates and route polylines captured during workouts) — fitness and activity-tracking services only; see Section 1.8
Assessment data (Fitness Assessment responses including a Physical Activity Readiness Questionnaire, self-reported activity level, and computed Ruck Readiness Score) — fitness services only; see Section 1.7
Wearable device data (data imported from Apple HealthKit, Bluetooth heart rate straps, Apple Watch, and similar devices) — fitness services only; see Section 1.9
Usage and device data (IP address, browser type, pages visited, timestamps, referring URLs, and interactions with links or buttons) — all services
Cookies and analytics identifiers, including data collected via Google Analytics, Google Ads Tag, Meta Pixel, TikTok Pixel, or similar technologies — websites only
Communications (messages you send us, chat conversations with any AI assistants we offer) — all services
Sensitive personal information. Some of the categories above (specifically health and biometric data) are classified as sensitive personal information under privacy laws such as the California Privacy Rights Act (CPRA) and the EU/UK General Data Protection Regulation (GDPR). We collect this information only when you use services that require it (such as Semper Ruck) and with your explicit consent through the applicable service. We do not use sensitive personal information for advertising, and we do not sell it under any circumstances.
1.2 How We Use Your Information
We use the information we collect to respond to your messages or requests, send updates or content you choose to receive, improve website performance and user experience, measure advertising performance, run targeted advertising campaigns, personalize content or ads where applicable, protect the security of our websites, and comply with legal or regulatory obligations.
We do not sell your data. We may share limited information with service providers such as analytics platforms, email service providers, or advertising networks so they can perform services on our behalf.
1.3 Advertising, Analytics, and Remarketing
We may use advertising and remarketing technologies such as the Google Ads Tag, Google Analytics, Meta Pixel, TikTok Pixel, LinkedIn Insight Tag, or similar tools. These technologies allow us to understand traffic patterns, measure ad effectiveness, and show ads on other websites based on your interactions with ours.
These third parties may collect or receive information from our websites and use it to provide measurement services or deliver relevant ads across the internet. You can opt out of interest-based advertising at any time using the methods listed in Section 3.3 below.
1.4 Data Security
We use reasonable technical and organizational measures to protect your information from unauthorized access or misuse. No online system is completely secure. You are responsible for safeguarding any login credentials tied to your use of our websites.
1.5 Your Rights
You may request access to the personal information we hold about you or ask that it be deleted. You may opt out of email communication at any time. Contact support@brettmatsuura.com to make a request.
We will respond in accordance with applicable law, including the CCPA and CPRA where relevant.

1.6 Children's Information
Our websites and services are not intended for anyone under 18. You must be 18 or older to use our services. We do not knowingly collect personal information from anyone under 18. If we learn we have collected information from someone under 18, we will delete it. If you believe that a child has provided personal information through our websites, please contact us and we will take reasonable steps to remove such information from our records.
1.7 Health and Biometric Data (Fitness Services)
This section applies to users of our fitness services, currently including Semper Ruck. If you do not use these services, we do not collect this data.
Because these services are fitness applications, we collect specific categories of health and biometric data. This section explains what we collect and why.
What we collect: Heart rate, resting heart rate, VO2 max estimates, body composition (weight, body fat percentage, circumference measurements), workout data (duration, distance, pace, load, elevation), Fitness Assessment responses, self-reported vitals (age, sex, height), and Physical Activity Readiness
Questionnaire Responses
How we collect it: Directly from you through intake screens and manual logging; automatically during workouts you record in the app; and by import from third-party health platforms you explicitly authorize (Apple HealthKit, Bluetooth heart rate devices, Apple Watch).
Why we collect it: To provide fitness tracking, calorie estimates, workout analysis, tier progression tracking, health screening prior to physical assessments, and personalized coaching. Health data is essential to the core function of our fitness service.
Health data storage and security: Health data is stored in our secure database with row-level security policies restricting access to the account owner. We do not sell or share health data with advertisers, data brokers, or any third party for marketing purposes.
Health data is not medical data: Semper Ruck is a fitness tracking application, not a medical device. Data collected is for personal fitness tracking only and is not intended to diagnose, treat, or prevent any medical condition.
1.8 Location Data (Activity-Tracking Services)
This section applies to users of our activity-tracking services, currently including Semper Ruck. If you do not use these services, we do not collect location data beyond IP-derived approximate location for security and analytics.
When you record an activity with GPS tracking enabled, we collect and store your device's GPS coordinates and generate a route polyline. Location data may be reverse-geocoded to provide human-readable location labels (for example, "Irvine, CA").
You control whether location tracking is enabled per workout. You may disable location services entirely in your device settings, though this will disable route mapping and location-based calorie adjustments.
Location data is stored with your workout records and is subject to the same access controls as your other personal data. We do not share location data with third parties, and we do not use it for targeted advertising.
1.9 Third-Party Health Integrations (Fitness Services)
This section applies to users of our fitness services, currently including Semper Ruck. If you do not use these services, we do not connect to third-party health data sources.
With your permission, we integrate with the following third-party health data sources:
Apple HealthKit — to import your workout, heart rate, resting heart rate, weight, and step data; and to export completed workouts back to Apple Health.
Bluetooth heart rate devices (chest straps, wrist sensors) — to receive live heart rate data during workouts.
Apple Watch — via Apple HealthKit.
Each integration requires your explicit permission via your device's system prompts. You may revoke any permission at any time in your device's Settings. Data flows directly between your device and our servers via secure API. We do not share your data with the manufacturers of these devices.
1.10 Data Retention
We retain your personal information for as long as your account is active, plus a period necessary to comply with legal obligations. When you delete your account, we delete or de-identify your personal data within 30 days, except where a longer retention period is required by law (for example, tax records must be retained for seven years).
Aggregated, de-identified data that no longer identifies you may be retained indefinitely for research, service improvement, and public reporting.
1.11 International Data Transfer
Our servers are hosted in the United States. If you access our services from outside the United States, your data will be transferred to and processed in the United States. By using our services, you consent to this transfer. Where required by law (for example, for EU or UK residents), we implement Standard Contractual Clauses or equivalent safeguards for the transfer.
1.12 Data Breach Notification
In the event of a data breach affecting your personal information, we will notify you by email and by an in-app notice as soon as reasonably possible after confirming the breach, in accordance with applicable laws.
1.13 AI and Algorithmic Processing
Some outputs of our fitness services, including the Ruck Readiness Score, workout classifications, calorie estimates, and coaching messages from our AI assistant "Gunny" are generated by algorithms and AI models. These outputs are estimates for personal fitness tracking purposes, not medical judgments. You may request human review of any algorithmic determination that materially affects you by contacting us at support@brettmatsuura.com.
